1. General Service Rates and Terms and Conditions of Service
In effect as of April 23, 2022 (For Private Clients)

I (each of the signatory to the Service Agreement and user of Evercare's placement service, hereinafter also referred to as a "Client") understand that save as exceptionally provided herein, the service rates set out shall apply for my engagement of nurses/healthcare workers placed by Evercare:

² PTA: Physiotherapist Assistant
* Night shift charge: 12am-6am
** Clients who wish to use therapist sessions must start with an assessment session. If client switches therapist type we must arrange another assessment session.
***Includes a Bioelectrical Impedance Analysis
Notice: Incomplete shift hours are charged in 30-min intervals based on the "Subsequent Hour Rate". For example, if a care professional works for 8 hours and 5 minutes, you will be charged 8.5 hours.
PAYMENT AND DEPOSIT TERMS
1. Payment Options
Customers must select one of the following payment methods before receiving services:
(i) Provide credit card details and pay a 30% deposit (calculated based on the total service fee of your first booking),
or
(ii) Prepay the full service fee or purchase a service package (via Bank Transfer, FPS, or Cheque).
2. Invoicing and Payment Terms
Invoices are issued every two weeks, with payment due within 7 days of the invoice date.

Please ensure the following for each transaction:
- Add a

Email or WhatsApp.
Credit Card
No surcharges apply.
Cheque
Mail a crossed cheque made payable to "Evercare Health Limited" to:
“Room 1301 & 1303, 13/F, Leighton Centre, 77 Leighton Road, Causeway Bay, Hong Kong”
Please write your Invoice Number on the back of the cheque (located at the top-right corner of the invoice, starting with a ‘#’).
3. Credit Card Details and Auto-Debit
Your credit card details will be securely stored and encrypted via Stripe, a PCI-compliant payment platform.
Evercare complies with the following:
- Hong Kong Personal Data (Privacy) Ordinance (PDPO) for card storage
- PCI DSS standards via Stripe (no raw card data is stored by Evercare)
Auto-Debit Consent:
During payment setup, you may choose to opt in or out of automatic deductions (auto-debit) for future invoices.
- If you opt in: Your stored card will be automatically charged for future invoices.
- If you opt out: You may pay by other methods. However, if payment is not received within 7 days of the invoice date, Evercare will deduct the overdue amount from your stored card.
Overdue Payments:
Regardless of your auto-debit preference, if payment is not made within 7 days of the invoice date, Evercare reserves the right to charge the outstanding amount to your stored credit card.
4. Deposit Refund Conditions
The 30% deposit will only be refunded under the following conditions:
- The client passes away before the service begins (with valid documentation), or
- Evercare is unable to provide a match within 3 days after the requested start date or 12 hours before the first scheduled service—whichever is earlier.
- If paid by credit card, refunds will be returned to the same card. Please note that Stripe’s processing fees are non-refundable.
5. Caregiver Replacement Policy
- You may request up to 2 caregiver replacements at no additional cost.
- If you decline the second match and do not proceed with the service, the deposit will be forfeited and non-refundable.
6. Unused Deposit and Refund Processing
- Any unused deposit will be held as platform credit for 3 calendar months from the date of payment.
- Refunds, when applicable, will be processed within
4–6 weeks.
SPECIAL SERVICE RATES
Special service rates of 2 times the rate set in the above pricing table applies to below days:
- First day of January
- Lunar New Year's Eve
- Lunar New Years 1st, 2nd, and 3rd day
- Day after Mid-Autumn Festival
- Winter Solstice Festival
- Christmas Day
- Boxing Day
- New Year's Eve
*Special service rates only apply to Evercare’s private home care services.
URGENT REQUEST CHARGE
An urgent request fee of $300 is charged if the request is made:
- less than 12 hours before service starts, OR
- after 6pm and service starts before 12pm the following day
This does not apply to emergency escort service.
SPECIAL TRANSPORT ALLOWANCE
A special transport allowance of $100/one way is charged if:
- service starts/ends at or before 6:00am
- service starts/ends at or after 12am
If the request meets both of the above conditions, the client will be charged two times of special transport allowance, i.e. $200. Special transport allowance is charged in addition to the night shift surcharge.
Evercare reserves the right to adjust the rates and terms and conditions set out herein without obtaining the Client's prior consent. Please call us for the latest and current applicable service rates and terms and conditions.
Meal Time: It is customary for the nurses/healthcare workers working a 6-hour shift to have a paid meal break of 30 minutes and 60 minutes for a 9-hour shift and above.

Optional service for long-term bed-bound patients: HCW can provide a 30-min massage therapy per service session to relieve muscle pain and to stimulate blood circulation of the patient.
In-home health tests
- Customers must present their identity cards on the appointment day
- Tests are for reference only, and is not suitable for diagnostic and/or treatment use
- Patients are not required to fast prior to blood test
- Tests will be processed at Precious Blood Hospital (Caritas) - Clinical Pathology Laboratory; which is a HOKLAS accredited lab
- The cost of the test does not include a doctor's consultation, patients who wish to obtain a diagnosis or interpretation after receiving the lab results should consult a general practitioner or specialist doctor on their own.
- Payment for tests are non-refundable. If you need to reschedule your test, please contact us at least 2 days prior to the original booking date.
2. TERMS & CONDITIONS
I understand that the following terms and conditions shall apply in order for Evercare to place nurses/healthcare workers to provide service as independent contractors for me:
i. Placement Agent.
Evercare is a placement agent which sources suitable nurses/healthcare workers to work for me and will charge me according to its current service rates:- I understand that nurses/healthcare workers are free to accept or decline a proposed placement and Evercare does not guarantee that it will successfully place me with an alternate nurse/healthcare worker although it will use its reasonable endeavors to do so.
ii. Independent Contractors.
Nurses/healthcare workers are engaged to provide service for me as independent contractors and they are not employees of Evercare;
I shall provide all necessary equipment (e.g. thermometers and sphygmometer etc) and consumable supplies (e.g. facemasks, gloves, etc) in order for the nurses/healthcare workers to carry out their work for me;
Evercare undertakes reasonable background checks on each nurse/healthcare worker that it places to work for Clients. However, these nurses/healthcare workers are independent contractors who are solely responsible for the conduct and standards of service they render;
Evercare will not accept:- (i) any responsibility for the conduct or service of the nurses/healthcare workers being placed to work for me or (ii) any liability in respect of their provision of service.
iii. Instructions/ Supervision.
It is my responsibility to directly instruct and supervise (or procure proper instructions or supervision of) the work of the nurses/healthcare workers being placed to work for me.
I acknowledge that the following persons may give valid instructions to nurses/healthcare workers who provide service for me:- (i) in respect of service provided to an individual patient - the signatory of the Service Agreement, the patient and/or person(s) whom the attending nurses/healthcare workers reasonably believe to be habitually in-charge of the patient's day-to-day care and (ii) in respect of service provided to a hospital or an institute - the signatory of the Service Agreement and/or any person whom the attending nurses/healthcare workers reasonably believe to be in-charge of the hospital ward, the institute or the patient, including the handling doctors and nurses.
When supervising the nurses/healthcare workers' work, I understand that I may follow the "Service Standards of Independent Contractors", which sets out Evercare's understanding of the service standards generally applicable to nurses/healthcare workers as independent contractors for Clients. I understand that I should also communicate directly to the nurses/healthcare workers in respect of any precise instructions I may have.
iv. Direct/Indirect Engagement.
I agree to pay Evercare a one-off introductory fee if I directly/indirectly engage a nurse/healthcare worker who has been placed by Evercare to work for me for a same/similar position ("Direct Engagement"). I further agree to notify Evercare's Care Coordinator of my intention to offer a nurse/healthcare worker a Direct/Indirect Engagement. This contractual obligation to notify Evercare upon any Direct/Indirect Engagement shall survive for a period of one year after the last date of a placement that particular nurse/healthcare worker had with me. I acknowledge that failure to notify Evercare of a Direct/Indirect Engagement will render Evercare's loss of introductory fee and that I shall therefore be liable to compensate Evercare by paying it the usual rate of introductory fee which is equivalent to the average of that particular nurse/healthcare worker's one month's income receivable from that Direct/Indirect Engagement. Evercare will endeavour to accommodate requested changes as much as possible, which will incur charges depending on the notice period as outlined below. Upon failure to do so, such requests will be treated as a cancellation.
v. Amendment of Service and Cancellation Charge

^ Service amendments include but are not limited to the following events that result in a change of caregiver: rescheduling service date/ time, changing service requirements, and shortening/ lengthening shift duration
⁺ Charges will only be waived on a case-by-case basis due to unforeseeable patient condition (e.g hospitalisation, discharge, or death). We reserve the right to request documentation proof for refund purposes. Evercare reserves the right of final decision.
*All refunds will be processed within 4-6 weeks
vi. Bad Weather
For care professionals working during black rainstorm warning, typhoon signal no.8 or above, the below special arrangement shall apply:
a) A special rate equal to 2 times the general rates shall apply to the entire shift if:
i. Black rainstorm warning is hoisted at any given point during the shift
ii. Typhoon signal no. 8 or above is hoisted at any given point during the shift
b) $200 transport fee one way if signal is in force at any point 1 hour before start or 1 hour after end of shift
c) Service cancellation policy:
i. Service shall continue as scheduled unless otherwise instructed
ii. If you wish to cancel the service, please inform us at least 4 hours before the shift starts or before 8pm if the shift starts before 12pm the following day. Otherwise, no refund shall be given.
iii. In the event that caregivers cancel service due to transport issues, we shall try our best to arrange a replacement
vii. Termination
I agree that either I or Evercare may give the other party notice in writing to terminate the Service Agreement with immediate effect without providing a cause; save that if I have an ongoing placement, the termination date of the Service Agreement shall be automatically postponed until the last date of such placement, or at an earlier date subject to the agreement with Evercare.
viii. Governing Law and Jurisdiction
The Service Agreement and this document shall be governed by and construed in accordance with the laws of Hong Kong and the parties submit to the non-exclusive jurisdiction of the Hong Kong Courts.
ix. Language
In case of any inconsistency between the English and Chinese versions of this document, the English version shall prevail.
3. Personal Information Collection Statement
I further agree that the personal data collected by Evercare in respect of its clients will be used by Evercare for placements and other related purposes, including but not limited to assessing my needs (and the patient's needs) and placing nurses/healthcare workers for me. My personal data is stored directly in Evercare's database which may only be accessed by Evercare's authorized employees, who will review the details of my personal data for the purposes of providing me with potentially suitable placements.
Evercare may disclose my personal data or any part thereof to:- (a) any nurse/healthcare worker who has indicated interest to provide me service; (b) any contractors, agents, other persons or bodies corporate engaged by Evercare for or in relation to any of the purposes listed above or any third party service providers who provide administrative, telecommunications, computer, or other service to Evercare; (c) any person by whom Evercare is required by applicable legal, governmental or regulatory requirements to make disclosure; and ( d) any other person reasonably requiring the same in order for Evercare to carry out the purposes set out herein.
I understand it is Evercare's policy to retain my personal data until six (6) calendar months after it receives my notice in writing to terminate the Service Agreement with it, or as otherwise required by law. Under the Personal Data (Privacy) Ordinance (Cap.486, Laws of Hong Kong), I am entitled to request access to and/or correction of my personal data in relation to my registration with Evercare. Any such request shall be made in writing, marked for the attention of the Manager and should be sent by post to: Evercare Health Limited, Room 1301 & 1303, 13/F Leighton Centre, 77 Leighton Road, Causeway Bay, Hong Kong
I agree that Evercare is entitled to charge a reasonable fee for processing any data access request. Evercare reserves the right to share the service scope of this Service Agreement for promotional and marketing purposes, including on Evercare's website(s), social media pages and other media channels, and Client grants to Evercare the right and license to utilize Client’s name, logo(s) and trademark(s) in connection with such promotional and marketing efforts.
4. Client Health Declaration

As you may be aware, Covid-19 has officially been declared a global pandemic. At Evercare, we are ready to face this challenge together with you and your loved ones. The Hong Kong SAR government has issued mandatory 14-day quarantine orders to everyone who has visited Covid-19 hotspots in the past 14 days. This is continuously changing, and an up-to-date list of travel safety guidelines is available here: https://www.coronavirus.gov.hk/eng/inbound-travel.html
- I agree to inform Evercare if I have visited any Covid-19 hotspots in the last 14 days.
- As far as I am aware, I have not developed any symptoms of coronavirus in the last 14 days, including, fever, chills & rigor, cough, sore throat, diarrhoea, shortness of breath or other symptoms related to the coronavirus. In the event I notice any of the aforementioned symptoms, I agree to notify Evercare immediately.
- If I plan to go anywhere outside of HK where there may be a chance of contracting the coronavirus, I agree to notify Evercare.
- I acknowledge and agree that Evercare, having procured the aforesaid declarations from its healthcare professionals, has done what it could in the circumstances to ensure that its healthcare professionals provided are free from coronavirus.
